Welcome to Jazz Drive, a secure and convenient cloud storage and data management platform offered by Pakistan Mobile Communications Limited (“Jazz”) in collaboration with Switch Communications (Pvt.) Ltd (“Vendor”). By registering for or using this service, you agree to these Terms of Service (“Terms”). If you do not agree, please discontinue use of the Service immediately.

1. Acceptance of Terms

By creating an account or using Jazz Drive, you confirm that you have read, understood, and agree to these Terms, forming a binding agreement between you (“User”, “you”) and Pakistan Mobile Communications Limited (“Jazz”, “we”, “our”, “us”).

• If you do not agree to these Terms, you cannot use Jazz Drive.
• We may update or modify these Terms periodically at our discretion. Updated Terms will be available at http://jazzdrive.com.pk/termsofuse.php. Continued use of the Service constitutes acceptance of the revised Terms.
• Additional features may be governed by specific Product Terms, which will take precedence in case of conflict with these Terms.

2. Account Registration & Eligibility

To access Jazz Drive, you must download the app and register an account.

You must:

• Be at least 18 years of age. Users under 18 may only use the Service with parental or guardian consent.
• Register as an individual (not a company or commercial entity).
• Provide accurate and complete information during registration and keep it up to date.
• Maintain the confidentiality of your login credentials. You are responsible for all activity under your account.
• If you suspect unauthorized access or misuse, contact customercare@switch.com.pk immediately.

Jazz reserves the right to:

• Limit the number of accounts created per device,
• Restrict the number of devices linked to a single account, and
• Suspend or terminate accounts that fail verification or payment obligations.

Your personal data will be handled in accordance with the Jazz Privacy Policy, available at http://jazzdrive.com.pk/privacypolicy.php.

3. Payments & Fees

• You are responsible for timely payment of all applicable subscription or usage fees.
• Valid payment information must be maintained at all times (credit card, prepaid recharge, or postpaid account).
• Failure to pay fees may result in termination or restricted access, and all stored data may be deleted permanently.
• To update your payment method or billing details, visit the Jazz Drive Platform or contact customercare@switch.com.pk.
• In case of non-payment or payment errors, access may be suspended until payment is verified.

4. Use of Service

Jazz Drive is provided to you on an “as is” and “as available” basis.

By using the Service, you agree to:

• Use Jazz Drive solely for personal and lawful purposes.
• Not resell, share, or redistribute access to others.
• Not attempt to copy, decompile, or reverse-engineer the Service or its software.

Jazz may introduce new features, updates, or modify existing ones without prior notice. Continued use after updates indicates acceptance of the changes.

5. Content Ownership & Usage Rights

You retain ownership of all content uploaded or stored on Jazz Drive (“Your Content”). However:

• By uploading or sharing content, you grant Jazz and its Vendor a limited license to process and manage your data for service delivery.
• Jazz and its Vendor may disclose data to law enforcement, courts, or the Pakistan Telecommunication Authority (PTA) when required by law.
• Unauthorized attempts to replicate, distribute, or interfere with the Service are prohibited and may result in termination or legal action.

6. Usage Policy

You agree that your content and activities on Jazz Drive shall not:

• Contain obscene, pornographic, or defamatory material.
• Impersonate, harass, threaten, or incite harm toward others.
• Promote unlawful, violent, or discriminatory behavior.
• Infringe intellectual property, confidentiality, or privacy rights.
• Advertise or promote commercial, political, or religious activities.
• Contain content breaching national security or integrity laws of Pakistan.

Additionally, you must not:

• Interfere with Jazz Drive operations or security systems.
• Upload data exceeding 1 TB.
• Attempt to hack, spread malware, or gain unauthorized access.
• Collect or harvest data from other users or systems.
• Use Jazz Drive for spamming, phishing, or any automated abuse.

Violations may lead to suspension, termination, or legal action, including indemnity claims by Jazz or affected third parties.

You are solely responsible for backing up your important data. Jazz does not guarantee protection from data loss due to termination, technical failure, or other unforeseen circumstances.

7. Feedback

We welcome your feedback regarding Jazz Drive.

All feedback submitted:

• Is treated as non-confidential and non-proprietary.
• May be freely used, implemented, or distributed by Jazz and its Vendor for product improvement without obligation or compensation.

8. Termination & Suspension

You may unsubscribe or terminate your Jazz Drive account at any time by contacting customercare@switch.com.pk.

Termination is irreversible and may require written confirmation from your registered email.

Jazz may terminate or suspend your account immediately if:

• You violate these Terms,
• Payment obligations are not met,
• Required identification is not provided,
• Fraud, illegal activity, or security concerns arise, or
• Service provision becomes unlawful or technically impractical.

Upon termination:

• Your account and content will be deleted after the applicable grace period, and
• Jazz bears no liability for any resulting data loss.

9. Data Retention & Deletion

Upon termination or cancellation:

• Your data will be retained for 45 days to allow retrieval or download.
• After 45 days, all content will be permanently deleted without the possibility of recovery.
• During this grace period, access will be restricted to data retrieval only.
• In case of non-payment or unresolved billing, Jazz may suspend the account but still provide a 45-day grace period for data retrieval.

10. Disclaimer of Warranties

Jazz provides the Service using reasonable skill and care but makes no guarantees that:

• Jazz Drive will be uninterrupted, secure, or error-free.
• Stored data will remain free from loss, corruption, or interference.
• Any defects will be corrected immediately.

The Service is provided “as is”, without any express or implied warranties of merchantability, fitness for purpose, or non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, Jazz, its affiliates, employees, vendors, and licensors shall not be liable for:

• Any direct, indirect, incidental, or consequential damages,
• Data loss, corruption, or unauthorized access,
• Temporary or permanent service suspension, or
• Loss of profits or goodwill.

This clause survives termination of the Terms.

12. Indemnification

You agree to defend, indemnify, and hold harmless Jazz, its Vendor, affiliates, and partners against all claims, damages, or losses arising from:

• Your use of Jazz Drive,
• Violation of these Terms, or
• Infringement of third-party rights.

This obligation continues after termination.

13. Intellectual Property & Copyright

All rights, title, and interest in Jazz Drive, including software, graphics, and design, belong to Jazz and/or its licensors.

You may not copy, reproduce, or use any proprietary materials except as permitted under these Terms.

3. Your full name, contact address, and email.

14. General Terms

• Jazz may discontinue or modify the Service at any time.
• Notices may be delivered via email, SMS, in-app notification, or through your registered account.
• Jazz may transfer its rights and obligations to another organization, with notice provided to users.
• Each clause operates independently—if any part is invalid, the remainder remains enforceable.
• Service interruptions caused by force majeure events (network failures, natural disasters, government actions, etc.) are not the responsibility of Jazz.

15. Dispute Resolution

For usage-related issues (e.g., billing or account access), contact customercare@jazz.com.pk.

For content-related matters (data deletion or management), contact customercare@switch.com.pk.

Both Jazz and its Vendor will coordinate to resolve concerns promptly.

16. Entire Agreement & Severability

These Terms constitute the entire agreement between you and Jazz and supersede any prior arrangements regarding Jazz Drive.

Failure to enforce any provision does not waive our rights.

If any part of these Terms is deemed unenforceable, the remainder shall remain valid and effective.
